1. Organiser

The organiser of the prize draw is TIMOCOM GmbH (hereinafter also referred to as TIMOCOM).

The recipient of the information provided by the participants is TIMOCOM GmbH. 

2. Profit

All eligible participants will be entered into a prize draw to win one of the following available Amazon vouchers: 1 x 100 euros, 2 x 75 euros, 7 x 50 euros.

Cash payment of the prize and transfer to other persons is not possible.

3. Duration of the prize draw

The prize draw starts on 06/08/2024 at 8:00a.m. and ends on 15/09/2024 at 6:00p.m.

4. Eligibility

Only people over the age of 18 are eligible to participate. Each survey participant is eligible for one prize draw entry only. Employees of the organiser of the prize draw and their relatives are excluded from participating.

5. Participation procedure

In order to participate in the prize draw, the participant must have a current licensing agreement with the organiser and have appropriately answered all questions in the survey that is the basis for prize draw participation. Place holders, irrelevant answers or joke answers may be determined by the organiser to be inappropriate answers.

6. Determining the winner

The winner will be chosen at random from all participants. The decision is made by random draw.

7. Date and type of notification

The winner will be informed by TIMOCOM by e-mail after the prize draw has ended. Each winner must contact TIMOCOM within five days of publication of the winner's notification by e-mail with their address and TIMOCOM ID. Failure to comply with this deadline will result in forfeiture of the right to win and the prize will be raffled again.

8. Awarding the prize

The prize, in the form of a voucher code, will be sent to the address provided by the winner in the survey. The prize is awarded and shipped by TIMOCOM GmbH.

To receive the prize, the participant may be required to provide a complete postal address so that the gift voucher can be sent (via post). For security reasons it will not be possible to pick up the prize or arrange a handover. The decision is final and cannot be subjected to legal action, cash payment in lieu of the gift voucher is not an option and transferring the prize to another person is forbidden.

9. Exclusion of participants

Each participant may only enter this prize draw once and can only win once. Participation shall also be excluded if there are justified reasons, such as a violation of the conditions of participation, undue influence on the prize draw, manipulation, etc. If necessary, prizes can also be subsequently withdrawn and reclaimed in these cases.

10. Extraordinary termination of the prize draw

The organisers reserve the right to modify, suspend or terminate the prize draw if this should be necessary due to force majeure or external circumstances beyond TIMOCOM's control or if this is the only way to ensure that the prize draw can be carried out properly.

11. Severability clause

Should any of the provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.

12. Other

The conditions of participation and the entire legal relationship between participant and TIMOCOM are subject exclusively to the laws of the Federal Republic of Germany. Place of jurisdiction is Dusseldorf.

There is no right of appeal.

К участию в анкете допускаются только лица старше 18 лет. Каждый участник анкеты (мужчина/женщина) имеет право на участие в розыгрыше приза только один раз. Сотрудники организатора розыгрыша и их родственники не могут принимать участие в розыгрыше. 

5. Как принять участие

Чтобы участвовать в розыгрыше призов, участник должен иметь действующее договорное соглашение с организатором и надлежащим образом ответить на все вопросы анкеты, это является основанием для участия в розыгрыше призов. Бессмысленные, неуместные или шуточные ответы организатор может посчитать некорректными. 

6. Определение победителя

Победитель будет выбран случайным образом из числа всех участников в конце вышеуказанного периода. Решение принимается случайным образом.

7. Дата и тип уведомления

Победитель получит уведомление от TIMOCOM по электронной почте после окончания розыгрыша. Каждый победитель должен связаться с TIMOCOM в течение пяти дней с момента опубликования уведомления победителя по электронной почте, указав свой адрес и идентификационный номер TIMOCOM. При несоблюдении этого срока право на выигрыш теряет силу, и розыгрыш приза проводится повторно. 

8. Награждение

Приз в форме кода ваучера будет отправлен на адрес, указанный победителем в опросе. Приз вручается и отправляется компанией TIMOCOM GmbH. 

Для получения приза участнику может потребоваться указать полный почтовый адрес для отправки подарочной карты (по почте). По соображениям безопасности получение и передача приза невозможны. Решение является окончательным и не может быть предметом судебных исков, оплата наличными вместо подарочного сертификата невозможна, а передача приза другому лицу запрещена.

Целью обработки данных является Ваше участие в розыгрыше призов. Мы обрабатываем Ваши данные исключительно в целях проведения розыгрыша призов. Данные, собранные для проведения розыгрыша призов, будут удалены через 6 месяцев после объявления победителя.

Если это указано в розыгрыше, вы предоставите нам свои данные в ответ на участие в розыгрыше, чтобы получать нашу рассылку по электронной почте. Вы можете в любое время отказаться от получения рассылки по электронной почте. Необходимую для этого ссылку Вы найдете в каждом электронном письме с новостной рассылкой. Передача Ваших данных другим компаниям или их использование в других целях без Вашего явно выраженного согласия запрещены.

10. Исключение участников

Каждый участник может принять участие в розыгрыше только один раз и выиграть только один раз. Участие в розыгрыше также исключается при наличии обоснованных причин, таких как нарушение условий участия, неправомерное влияние на розыгрыш, манипуляции и т. д. 11. Досрочное прекращение розыгрыша призов

Если какое-либо из положений условий участия является или станет недействительным, это не влияет на действительность остальных условий участия.

Условия участия и все правовые отношения между участником и TIMOCOM регулируются исключительно законодательством Федеративной Республики Германия. Местом рассмотрения споров является Дюссельдорф. 

Обращение в суд исключено.

To enter the prize draw, the following steps are required:

1. Visit the exhibition booth: Visit the TIMOCOM GmbH exhibition booth at LogiMAT in Stuttgart.
2. Enter the Speed Challenge Take part in our Speed Challenge. You will be given the task of posting a freight offer on the TIMOCOM freight exchange as quickly as possible based on a given e-mail. Stop the timer yourself by pressing a buzzer.
3. Fill out the form: Enter your time and your name in the entry form provided. All participants who complete the form correctly and successfully submit the freight offer at the TIMOCOM GmbH exhibition booth will be entered into the prize draw.

The prize, in the form of a voucher code, will be sent to the address provided by the winner. The prize is awarded and shipped by TIMOCOM GmbH.

To receive the prize, the participant may be required to provide a complete postal address so that the gift voucher can be sent (via post). For security reasons it will not be possible to pick up the prize or arrange a handover. The decision is final and cannot be subjected to legal action, cash payment in lieu of the gift voucher is not an option and transferring the prize to another person is forbidden.

9. Purpose of processing

The purpose of the processing is your participation in the prize draw. We process your data solely for the purpose of carrying out the prize draw. The data collected for the implementation of the prize draw will be deleted 6 months after the winner has been declared.

In the event that this is stated in the prize draw, you will provide us with your data in return for participating in the prize draw in order to receive our e-mail newsletter. You can opt-out of receiving the e-mail newsletter electronically at any time. The link required for this can be found in every newsletter e-mail. Your data will not be passed on to other companies or used for other purposes unless you give us your explicit consent.

10. Exclusion of participants

Each participant may only enter this prize draw once and can only win once. Participation shall also be excluded if there are justified reasons, such as a violation of the conditions of participation, undue influence on the prize draw, manipulation, etc. If necessary, prizes can also be subsequently withdrawn and reclaimed in these cases.

11. Extraordinary termination of the prize draw

The organisers reserve the right to modify, suspend or terminate the prize draw if this should be necessary due to force majeure or external circumstances beyond TIMOCOM's control or if this is the only way to ensure that the prize draw can be carried out properly.

12. Severability clause

Should any of the provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.

13. Other

The conditions of participation and the entire legal relationship between participant and TIMOCOM are subject exclusively to the laws of the Federal Republic of Germany. Place of jurisdiction is Dusseldorf.

There is no right of appeal.

1. Veranstalter

Veranstalter des Gewinnspiels ist die TIMOCOM GmbH (nachfolgend auch als TIMOCOM genannt).

Der Empfänger der von den Teilnehmenden bereitgestellten Informationen ist die TIMOCOM GmbH. 

2. Gewinn

Unter allen zulässigen Teilnahmen werden insges. 10 x 50,- Euro Wunschgutscheine ausgelost.

Eine Barauszahlung des Gewinns und die Übertragung auf andere Personen ist nicht möglich.

3. Gewinnspieldauer

Das Gewinnspiel beginnt am 01.03.2025 um 08:00 Uhr und endet am 31.05.2025 um 18:00 Uhr. 

4. Teilnahmeberechtigung

Teilnahmeberechtigt sind Personen, die das 18. Lebensjahr vollendet haben. Jede/r Teilnehmer/in an der Umfrage ist nur zur einmaligen Teilnahme an der Verlosung berechtigt. Mitarbeite/innen des Veranstalters des Gewinnspiels sowie deren Angehörige sind von der Teilnahme ausgeschlossen.

5. Teilnahmehandlung

Voraussetzung für die Teilnahme an der Verlosung ist die ordnungsgemäße Beantwortung aller Fragen der zugrundeliegenden Umfrage. Platzhalter, sachfremde Antworten oder Scherzantworten können nach Ermessen des Veranstalters als nicht-ordnungsgemäße Antworten angesehen werden. 

6. Gewinnermittlung

Der/die Gewinner/innen werden aus allen Teilnehmer/innen nach Ablauf der Gewinnspieldauer per Zufallsprinzip ermittelt. Das Los entscheidet.

7. Zeitpunkt und Art der Benachrichtigung

Der/die Gewinner/in wird nach Ablauf des Teilnahmeschlusses von TIMOCOM per E-Mail informiert. Jeder Gewinner muss sich innerhalb von fünf Tagen ab Veröffentlichung der Gewinnmitteilung per E-Mail bei TIMOCOM mit seinen Adressdaten, sowie seiner TIMOCOM ID melden. Die Nichtbeachtung dieser Frist hat ein Erlöschen des Gewinnanspruchs zur Folge und der Gewinn wird erneut verlost.

8. Gewinnübermittlung

Die Gewinnübermittlung erfolgt per Gutscheincode an die von dem Gewinner angegebenen Adresse. Die Gewinnübermittlung und Versandabwicklung erfolgt über die TIMOCOM GmbH.

Zur Gewinnübergabe ist ggf. die Angabe einer vollständigen Adresse für den (Post-)Versand erforderlich, eine Abholung oder Übergabe ist aus Sicherheitsgründen nicht möglich. Rechtsweg und Barauszahlung sowie Übertragung des Gewinns an andere Personen sind ausgeschlossen.

9. Zweck der Verarbeitung

Der Zweck der Verarbeitung ist Ihre Teilnahme an dem Gewinnspiel. Wir verarbeiten Ihre Daten ausschließlich für die Durchführung des Gewinnspiels. Die für die Durchführung des Gewinnspiels erhobenen Daten werden spätestens 6 Monate nach Abwicklung des Gewinnspiels gelöscht.

Für den Fall, dass dies im Gewinnspiel angegeben ist, überlassen Sie uns Ihre Daten im Gegenzug für die Teilnahme am Gewinnspiel für die Zusendung unseres E-Mail-Newsletters. Sie können den Empfang des E-Mailnewsletters jederzeit wieder elektronisch abbestellen. Den dafür notwendigen Link finden Sie in jedem E-Mailnewsletter. Ihre Daten werden nicht an andere Unternehmen weitergegeben oder für andere Zwecke verwendet außer Sie erteilen uns Ihre explizite Einwilligung.

10. Ausschluss von Teilnehmern

Jeder/Jede Teilnehmer/in darf nur einmalig an diesem Gewinnspiel teilnehmen und kann nur einmal gewinnen. Die Teilnahme ist ebenfalls auszuschließen, sofern berechtigte Gründe, wie ein Verstoß gegen die Teilnahmebedingungen, unzulässige Beeinflussung des Gewinnspiels, Manipulation etc. vorliegen. Gegebenenfalls können in diesen Fällen auch nachträglich Gewinne aberkannt und zurückgefordert werden.

11. Außerordentliche Beendigung des Gewinnspiels

Die Veranstalter behalten sich vor, die Aktion zu modifizieren, auszusetzen oder zu beenden, soweit dies aufgrund höherer Gewalt oder äußerer, nicht von TIMOCOM zu beeinflussender Umstände erforderlich sein sollte oder wenn nur so eine ordnungsgemäße Durchführung der Aktion gewährleistet werden kann.

12. Salvatorische Klausel

Sollten einzelne Bestimmungen der Teilnahmebedingungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bedingungen unberührt.

13. Sonstiges

Diese Teilnahmebedingungen und die gesamte Rechtsbeziehung zwischen den Teilnehmenden und der TIMOCOM GmbH unterliegen ausschließlich dem Recht der Bundesrepublik Deutschland. Der Gerichtsstand ist Düsseldorf.

Der Rechtsweg ist ausgeschlossen.

Организатором розыгрыша является компания TIMOCOM GmbH (далее именуемая также TIMOCOM).

Получателем информации, предоставляемой участниками, является TIMOCOM GmbH. Эти данные будут использоваться для розыгрыша призов и подписки на новостную рассылку. При регистрации на розыгрыш призов участник был проинформирован о том, что подписка на новостную рассылку является необязательной и может быть отменена в любое время.

2. Приз

Каждый месяц, начиная с июня до декабря 2025 года, мы будем разыгрывать призовые деньги в размере чистой стоимости допустимого заказа на грузоперевозку, который был обработан через TIMOCOM Marketplace, с максимальным лимитом до 1,500 евро.

При распределении приза используются ID пользователя и TIMOCOM ID, при этом пользователь TIMOCOM получает ваучер на 250 евро. Победившая компания по TIMOCOM ID может представить любые счета за грузоперевозки, соответствующие критериям участия в данном месяце, для получения призовой выплаты на счет, с которого оплачивается абонентская плата за TIMOCOM. Кроме того, пользователь TIMOCOM, чей ID будет выбран в розыгрыше, получит ваучер на 250 евро.

Первые 100 пользователей TIMOCOM, соответствующих требованиям для участия в розыгрыше призов, указанным в пункте 5. Пользователи, соответствующие критериям участия, получат приятный сюрприз (мягкую игрушку Мо или коврик для мыши).

Выплата наличными и передача приза другим лицам невозможна.

3. Продолжительность розыгрыша

Розыгрыш призов начнется 01/06/2025 в 00:00 и закончится 31/12/2025 в 23:59.

4. Условия участия

Право на участие имеют все пользователи, имеющие TIMOCOM ID и действующее соглашение на момент выплаты или отправки приза, при условии наличия активных прав пользователя. Каждое физическое лицо должно обладать активным TIMOCOM ID, постоянным местом жительства в ЕС и достигнуть 18-летнего возраста. Сотрудники организатора розыгрыша и их родственники не могут принимать участие в розыгрыше.

5. Требования к участникам

Для того чтобы принять участие в розыгрыше призов, участники обязаны для каждого TIMOCOM ID:

• заполнить регистрационный формуляр с адресом электронной почты, используемым для входа в TIMOCOM
• в каждом месяце разместить не менее трех предложений грузов на Транспортной Бирже TIMOCOM, используя TIMOCOM AI
• использовать TIMOCOM Messenger как минимум три раза в месяц для общения с другими клиентами TIMOCOM
• в каждом месяце заключить минимум три сделки на TIMOCOM Marketplace

Регистрируясь для участия в розыгрыше призов, участники соглашаются с тем, что TIMOCOM может анализировать их поведение на TIMOCOM Marketplace для проверки соблюдения указанных выше условий участия.

Участие с использованием массовых автоматизированных методов не допускается.

6. Определение победителя

Каждый месяц среди всех участников будет случайным образом выбран победитель. Решение принимается случайным образом.

7. Дата и тип уведомления

TIMOCOM сообщит победителю по электронной почте или телефону в месяце, следующем за его участием. Каждый победитель должен связаться с TIMOCOM в течение пяти дней после публикации уведомления о победе по электронной почте, указав свой адрес и TIMOCOM ID. Несоблюдение данного срока приведет к потере права на получение приза, который будет разыгран повторно.

При контакте с TIMOCOM и принятии приза, победитель соглашается записать видеообращение о розыгрыше призов и о функциях/сервисах TIMOCOM, таких как TIMOCOM AI, TIMOCOM Messenger и Сделки, которые могут быть использованы TIMOCOM в маркетинговых целях (например, на TIMOCOM Marketplace, в новостных рассылках и социальных сетях).

Принимая участие в данном розыгрыше, компания-участник подтверждает, что несет ответственность за правильное налогообложение всех призов в соответствии с действующим налоговым законодательством. Это в первую очередь включает ответственность за уплату фиксированного налога на доход от денежной выгоды, если на призы такая уплата налога обязательна в соответствии с законодательством. Компания, принимающая участие, подтверждает, что готова предоставить всю необходимую информацию и выполнить все актуальные налоговые обязательства. Участник освобождает TIMOCOM от любых требований со стороны налоговых органов в связи с этим призом.

8. Награждение

TIMOCOM GmbH использует TIMOCOM ID или ID пользователя для проверки условий участия, указанных в пунктах 4 и 5. Приз будет отправлен победителю по почте. Приз вручается и отправляется компанией TIMOCOM GmbH. Участник освобождает TIMOCOM от любых требований со стороны налоговых органов в связи с этим призом.

9. Исключение участников

Каждый участник может участвовать в розыгрыше каждый месяц, но выиграть может только один раз в течение всего срока проведения розыгрыша. В случае обоснованных причин, таких как нарушение условий участия, неправомерное воздействие на розыгрыш призов, манипуляции и причины, оправдывающие немедленное расторжение лицензионного соглашения с TIMOCOM, участники будут исключены. В таких ситуациях призы могут быть аннулированы.

10. Досрочное прекращение розыгрыша призов

Организатор оставляет за собой право на изменение, приостановку или прекращение розыгрыша, если это необходимо по причине форс-мажорных обстоятельств или внешних обстоятельств, не зависящих от TIMOCOM, или если это единственный способ обеспечить надлежащее проведение розыгрыша.

11. Условие о том, что часть соглашения может быть исключена

Если какое-либо из положений условий участия является или станет недействительным, это не влияет на действительность остальных условий участия.

12. Прочее

Условия участия и все правовые отношения между участником и TIMOCOM регулируются исключительно законодательством Федеративной Республики Германия. Местом рассмотрения споров является Дюссельдорф.

Обращение в суд исключено.
